Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") govern your access to and use of the Kåduka websites, apps, and services (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years old, or the minimum age of digital consent in your country, to use the Service. By using the Service you confirm that you meet this requirement and that the information you provide is accurate.

3. Your account

You are responsible for keeping your login credentials secure and for all activity under your account. Tell us promptly at [email protected] if you suspect unauthorized use. We may suspend or close accounts that violate these Terms.

4. Safety, assumption of risk, and release

Kåduka provides trail information, routes, maps, conditions, and planning tools for general reference only. Trail running and outdoor activity carry inherent and significant risks, including physical injury, becoming lost, exposure, changing weather, wildlife encounters, and death. Route data, distances, elevation, surface, difficulty, and conditions may be inaccurate, out of date, or incomplete. You are solely responsible for evaluating your own fitness, skills, equipment, and the current conditions, and for your own safety and the safety of anyone in your party.

You acknowledge and voluntarily accept these risks. You agree to use the Service at your own risk and not to rely on it as your only source of safety-critical information.

To the fullest extent permitted by law, and in consideration of your access to the Service, you release and agree not to hold Kåduka, its owners, and its team responsible for claims, injuries, losses, or damages, including personal injury or death, arising out of your outdoor activities or your reliance on trail, route, map, or conditions data provided through the Service. This release does not apply where it is prohibited by law, and nothing in these Terms limits any liability that cannot be limited under applicable law, for example liability for gross negligence or willful misconduct where the law does not permit its exclusion.

5. Plus subscription and billing

Kåduka offers a paid subscription ("Plus"). Payments are processed by our payment provider, Stripe. By starting a paid subscription you authorize us and Stripe to charge your payment method on a recurring basis until you cancel.

• Subscriptions renew automatically for the same term unless you cancel before the renewal date.
• You can cancel at any time in your account settings. Cancellation takes effect at the end of the current billing period.
• Prices, terms, and any free or promotional periods (for example the launch offer of three months of Plus at no charge) are shown at the point of sale and may change with notice for future terms.
• Except where required by law, payments are non-refundable.

6. Your content

You keep ownership of the content you post, including activities, routes, photos, comments, and profile information ("Your Content"). By posting Your Content, you grant Kåduka a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, and display it for the purpose of operating, improving, and promoting the Service. You are responsible for Your Content and confirm you have the rights to post it. Do not post content that infringes others' rights, that is unlawful, or that you do not have permission to share, including GPS tracks or photos of private property or other people without consent.

7. Acceptable use

You agree not to:

• break the law or use the Service to harm others,
• harass, threaten, impersonate, or invade the privacy of others,
• scrape, harvest, or bulk-download data except as expressly allowed,
• probe, disrupt, or attempt to gain unauthorized access to the Service or its systems,
• misrepresent trail or route information in a way that could endanger others, or
• upload malware or interfere with the Service.

8. Device and third-party integrations

The Service can connect to third-party platforms and devices you choose to link, such as Suunto, COROS, Garmin, and Apple Health, to import your activity data. Your use of those platforms is governed by their own terms and privacy policies. We are not responsible for third-party services, and you can disconnect them at any time in your settings.

9. Intellectual property

The Service, including its software, design, branding, and content we provide, is owned by Kåduka or its licensors and is protected by law. We grant you a limited, personal, non-transferable license to use the Service under these Terms. You may not copy, modify, resell, or create derivative works from the Service except as allowed by law or with our permission.

10. Termination

You may stop using the Service and close your account at any time. We may suspend or end your access if you breach these Terms or to protect the Service or other users. Sections that by their nature should survive termination will survive, including content licenses already granted, disclaimers, the release and assumption of risk, and limitation of liability.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and accuracy of trail, route, or conditions data, to the fullest extent permitted by law.

12. Limitation of liability

To the fullest extent permitted by law, Kåduka and its team will not be liable for any indirect, incidental, special, or consequential damages, or for any loss arising from your use of or inability to use the Service, including any reliance on trail, route, or conditions data. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD 100.

13. Data deletion and retention

You may request deletion of your account and associated personal data at any time through your account settings or by contacting us at [email protected]. Upon a verified deletion request, we will delete or anonymize your personal data, including your profile information, activity and route data, TrailIQ recommendation history, and stats, within 30 days, except as described below. This section works together with our Privacy Policy.

We may retain certain data where required to:

• comply with legal, tax, or regulatory obligations,
• resolve disputes, enforce our agreements, or investigate abuse or fraud,
• maintain aggregated or de-identified data that cannot reasonably be linked back to you, for example anonymized route popularity or usage statistics, or
• preserve backups for a limited period, after which they are purged or overwritten in the ordinary course of our backup cycle.

If you participate in community features such as Events or shared routes, content you contributed that is visible to or relied upon by other users may be retained in de-identified or attributed form after account deletion, unless you request its removal separately.

Deletion is permanent and cannot be undone. If you rejoin Kåduka after deletion, you will need to create a new account and will not retain prior activity history, progress, or contributions.

14. Changes to the Service and these Terms

We may update the Service and these Terms from time to time. If we make material changes, we will provide reasonable notice, for example by posting the new date above or notifying you in the app. Continued use after changes take effect means you accept the updated Terms.

15. Governing law and disputes

These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law rules. Any dispute relating to these Terms or the Service will be brought exclusively in the state or federal courts located in King County, Washington, and you consent to their jurisdiction.
